Terms of Service

1. Acceptance of Terms

By accessing or using Foo (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Foo provides automated Lighthouse monitoring for website performance, SEO, and accessibility. We run audits on your behalf and surface results through our dashboard and API.

3. Accounts and Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Subscription and Billing

Paid plans are billed monthly or annually as selected at checkout. All fees are charged in advance and are non-refundable except as required by law.

  • Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. We do not issue pro-rated refunds for unused time within a billing cycle.
  • Payment processors: New subscriptions are processed through Stripe. Legacy accounts created before our migration may still be billed through Braintree for continuity purposes.
  • Plan changes: Upgrading or downgrading takes effect at the start of your next billing cycle.
  • Failed payments: If payment fails, your account will enter read-only mode. Resolving payment restores full access. If payment remains unresolved, your subscription may be cancelled.

5. Data Retention After Cancellation

After your subscription ends, your account data (pages, audit history, settings) is retained for 30 days in a read-only state. After 30 days, your account and all associated data are permanently and irreversibly deleted. You may re-subscribe at any time within the 30-day window to restore full access and prevent deletion.

6. Acceptable Use

You agree not to use the Service to violate any law, infringe on any third-party rights, or interfere with the integrity or performance of the Service. We reserve the right to suspend or terminate accounts that violate these terms.

7. Analytics and Tracking

We use PostHog for product analytics to understand how users interact with the Service and to improve it. PostHog may collect information such as pages visited, features used, and browser metadata. We do not sell your data to third parties. You may opt out of analytics tracking by contacting us at hello@foo.software.

8. Intellectual Property

The Service and all content within it are owned by Foo. You retain ownership of the URLs and data you submit to the Service. You grant us a limited license to process your data solely to provide the Service.

9. Disclaimer of Warranties

The Service is provided “as is” without warranty of any kind. We do not guarantee uptime, accuracy of audit results, or uninterrupted access.

10. Limitation of Liability

To the maximum extent permitted by law, Foo shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

11. Changes to These Terms

We may update these terms at any time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
